FAYETTEVILLE, Ark. – Here's some food for thought: If you have nude photos of your wife on your cell phone, hang onto it. Phillip Sherman of Arkansas learned that lesson after he left his phone behind at a McDonald's restaurant and the photos ended up online. Now he and his wife, Tina, are suing the McDonald's Corp., the franchise owner and the store manager. The suit was filed Friday and seeks a jury trial and $3 million in damages for suffering, embarrassment and the cost of having to move to a new home. The suit says that Phillip Sherman left the phone the Fayetteville store in July and that employees promised to secure it until he returned. Manager Aaron Brummley declined to comment, and other company officials didn't return messages.

Suing McDonald's? Because he forgot his phone?

Maybe there are some facts that are left out in the story. If the store manager found it and posted the pics, well, then maybe I could understand.

Apparently that is what happened. Sort of. Mr. Sherman apparently contacted the store and they confirmed they had his phone and would secure it until his return.

Arkansas man Phillip Sherman is suing McDonalds claiming that nude photographs of his wife Tina Sherman were uploaded onto to a website after misplacing his cell phone at a Fayetteville, McDonalds restaurant.

Nude Photos? Not!
Sherman claims he left his phone at the Fayetteville, Arkansas McDonalds location on July 5. A manager reportedly confirmed by phone that Sherman's cell would be secure until he returned.

A short time later naked pictures of Tina, that resided on the cell phone, allegedly made their way online. The suit $3 million alleges that the photos were uploaded onto a website, thoughtlessly publishing Tina Sherman's name, address, and contact information.

The lawsuit also alleges that before Phillip could get his cell phone back from McDonalds, Tina Sherman starting receiving text messages from her husband's phone in response to her pictures. One text message stated:

"I've seen your pictures Tina, I liked what I saw."

Because of this story hitting the mainstream news, the search terms "Tina Sherman" and "Tina Sherman Nude" have permeated the web.

Anyone could have download the phone info before the McD workers found the phone.
All you need for a phone to phone transfer is the right jack to plugin the phone.

U dont even need that Scarecrow all u need is your bluetooth to be on to transfer data phone 2 phone or even on to your laptop.

You think its someone trying to beat the credit crunch with a cunning ploy?

There is nothing to say that the SIM card in the phone was his usual phone. The messages could have come from his sim card in a substitute phone.

The photo, if it was ever on the original phone, could have been uploaded from anywhere.

It's strange.

Wouldn't be any problem if we just all adopted nudity as a lifestyle (when it's warm enough at least). :)

I suppose, though, that then we could file a lawsuit if someone found pictures with people wearing clothes. :rolleyes2
