Men Paid To Live In Single-Family Residence Violates Code, City Says

MIAMI -- A hearing on Monday before the Miami Code Enforcement Board continued a debate about a business in a Miami residential neighborhood that the city said is operating as an adult business, a violation of Miami city code.

Officials from the city of Miami said they want to shut down the house on Northeast 27th Street, where men are being paid to live and have sex with each other for broadcast on a pornographic Web site.

The property is being used as a rooming house and not as a single-family residence because there are more than three adults living in the home, said Assistant City Attorney Victoria Mendez on Monday.

The attorney for Flava Works, a Miami-based company that operates the Web site, said that nothing is sold out of the house and that customers pay to sign on to the services and no money changes hands.

Attorney James Benjamin said all of the activity is broadcast on the Web and that the operation is not open to the public, so it does not fit the criteria of an adult business.

Nevertheless, city officials ultimately ruled that the residents must vacate the premises within 24 hours, but Benjamin said he would file an emergency motion in federal court Tuesday.

The code enforcement board dismissed the charge of illegal rooming house, but the charges of operating an adult entertainment business and illegally operating a business in a residential area require immediate action.

Monday's hearing was a continuation. Local 10's Kellie Butler said this is the third time the issue has been before the code enforcement board.
